Welcome to Leads Genie!

These Terms of Service (“Terms”) govern your use of the Leads Genie website located at www.leadsgenie.online (the “Site”) and the services offered by Leads Genie (collectively, the “Services”).

Before you start using the Services, please read these Terms carefully.

By accessing or using the Services, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use the Services.

Please note that these Terms may be updated from time to time. We will notify you of any significant changes. Your continued use of the Services constitutes your acceptance of the revised Terms.

1. AGREEMENT TO TERMS

These Terms constitute a legally binding agreement between you (“you” or “User”) and Leads Genie (“Leads Genie,” “we,” “us,” or “our”) regarding your access to and use of the Services.

2. INTELLECTUAL PROPERTY RIGHTS

The Services and all content included on the Site, including but not limited to text, graphics, logos, images, audio clips, video clips, software, and data (collectively, the “Content”) are the property of Leads Genie or its licensors and are protected by copyright, trademark, and other intellectual property laws. You agree not to remove, alter, or obscure any copyright, trademark, or other proprietary rights notices contained on the Site or in the Content.

3. USER REPRESENTATIONS

By using the Services, you represent and warrant that:

You are at least 18 years of age or the legal age of majority in your jurisdiction to form a binding contract.
You will comply with all applicable laws and regulations in connection with your use of the Services.
You will not use the Services for any unlawful or unauthorized purpose.

4. USER REGISTRATION

You may be required to register for an account to access certain features of the Services. You are responsible for maintaining the confidentiality of your account information, including your username and password. You are also responsible for all activities that occur under your account.

5. FEES AND PAYMENT

Some of the Services may be subject to fees. You agree to pay all fees associated with your use of the Services in accordance with the payment terms then in effect.

6. FREE TRIAL

We may offer a free trial of certain Services. You may be required to provide a payment method to activate the free trial. If you do not cancel the free trial before the end of the trial period, you will be automatically charged for the applicable subscription fee.

7. CANCELLATION & REFUND POLICY

You may cancel your subscription at any time. Cancellation will be effective at the end of your current billing period.

We do not offer pro-rata refunds on our packages, but you may continue to use the services as normal for the current billing period.

We offer a 14-day money-back guarantee on our social media design services only. Please contact us within 14 days of the first post going live to receive a full refund for the first month only.

8. PROHIBITED ACTIVITIES

You are prohibited from using the Services for any of the following purposes:

To violate any law or regulation.
To infringe on the rights of any third party.
To transmit any harmful, obscene, or unlawful content.
To interfere with the security of the Services.
To use the Services for any commercial or unauthorized purpose.
To engage in any activity that is detrimental to or interferes with the Services or the rights of other users.

9. USER GENERATED CONTRIBUTIONS

The Services may allow you to submit content, such as reviews, comments, and other materials (“User Generated Contributions”). You retain all ownership rights to your User Generated Contributions. However, by submitting User Generated Contributions to the Services, you grant Leads Genie a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, publish, and distribute your User Generated Contributions in connection with the Services.

10. CONTRIBUTION LICENSE

You represent and warrant that you have all necessary rights to grant the licenses granted in Section 9 above. You further represent and warrant that your User Generated Contributions do not and will not infringe on the rights of any third party.

11. GUIDELINES FOR REVIEWS

Reviews submitted to the Services must be truthful and based on your own experience. You may not submit reviews that are:

Promotional in nature.
Based on personal relationships with the reviewed party.
Offensive, defamatory, or discriminatory.
In violation of any applicable laws or regulations.

12. MOBILE APPLICATION LICENSE

If you access the Services through a mobile application, you acknowledge and agree that the following terms apply:

You may need to download and install the mobile application from a third-party app store (e.g., Apple App Store, Google Play Store).
Your use of the mobile application is subject to the terms and conditions of the applicable app store.
Leads Genie is not responsible for any fees or charges associated with downloading or using the mobile application.

13. SOCIAL MEDIA

The Services may include features that allow you to connect with us on social media. Your use of these features is subject to the terms and conditions of the applicable social media platform.

14. SUBMISSIONS

If you submit any ideas, suggestions, documents, or other materials to Leads Genie (collectively, “Submissions”), you agree that such Submissions are non-confidential and shall become the sole property of Leads Genie. Leads Genie shall have the exclusive right to use, reproduce, disclose, and otherwise exploit such Submissions for any purpose whatsoever, without compensation to you.

15. THIRD-PARTY WEBSITES AND CONTENT

The Services may contain links to third-party websites and services that are not owned or controlled by Leads Genie. We are not responsible for the content, accuracy, or opinions expressed on such third-party websites.

16. U.K. GOVERNMENT RIGHTS

If you are a UK Government agency, the following applies: (a) the Services are “commercial items” as that term is defined at 48 C.F.R. 2.101, consisting of “commercial computer software” and “commercial computer software documentation,” as such terms are used in 48 C.F.R. 12.212 or 48 C.F.R. 227.7202, as applicable; and (b) the Government’s rights in software and documentation will be only those rights set forth herein and in 48 C.F.R. 12.212 or 48 C.F.R. 227.7202, as applicable.

17. SITE MANAGEMENT

We reserve the right to modify or discontinue the Services, in whole or in part, at any time without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Services.

19. COPYRIGHT INFRINGEMENTS

We respect the intellectual property rights of others. If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement, please notify us in accordance with the Digital Millennium Copyright Act (“DMCA”) or the relevant provisions of the Copyright, Designs and Patents Act 1988 (as amended).

20. TERM AND TERMINATION

These Terms will remain in effect until terminated by either party. You may terminate these Terms at any time by discontinuing your use of the Services. Leads Genie may terminate these Terms at any time without notice if you violate any provision of these Terms.

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

23. DISPUTE RESOLUTION

Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the English courts.

24. CORRECTIONS

We may make corrections and/or changes to these Terms at any time, and such changes will be effective immediately upon posting. You are responsible for reviewing these Terms periodically for any changes.

25. DISCLAIMER

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

26. LIMITATIONS OF LIABILITY

IN NO EVENT SHALL LEADS GENIE, ITS AFFILIATES, OR THEIR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING, BUT NOT LIMITED TO, LOSS OF PROFITS, DATA LOSS, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES, EVEN IF LEADS GENIE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

27. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Leads Genie and its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including, without limitation, reasonable attorneys’ fees and court costs) arising from or relating to: (i) your use of the Services; (ii) your breach of these Terms; (iii) your violation of any applicable law or regulation; (iv) your infringement, or the infringement by any other user of your account, of any third party’s intellectual property rights or other rights; (v) your negligent or willful misconduct; and (vi) any claim arising out of your use of the Services to interact with any other user. This indemnification obligation will survive the termination of these Terms.

28. USER DATA

We may collect and store certain information about your use of the Services (“User Data”). This may include information such as your IP address, browser type, operating system, referring URLs, and information about the pages you access on the Site. We may use this information to improve the Services, analyze trends, and administer the Site.

29. ELECTRONIC COMMUNICATIONS, TRANSACTIONS, AND SIGNATURES

You agree that by using the Services, you consent to receive electronic communications from us, including but not limited to email, text messages, and push notifications. You also agree that you may be required to provide your electronic signature for certain transactions.

If you are a California resident, you may have certain rights under the California Consumer Privacy Act (“CCPA”). Please refer to our Privacy Policy for further information regarding your CCPA rights.

31. LEADS GENIE CONSULTANTS

A. Service Overview:

Leads Genie offers a network of qualified and vetted consultants (“Leads Genie Consultants”) to assist you with various tasks related to growing your leads and business. These consultants are independent contractors who have completed our training program and are familiar with the Leads Genie platform.

B. Finding the Right Consultant:

Leads Genie provides a search tool to help you find a consultant who meets your specific needs. You can filter consultants by expertise, experience, and hourly rate.

C. Engagement and Fees:

To engage a Leads Genie Consultant, you will directly communicate with them through the Leads Genie platform. This ensures a smooth workflow and facilitates communication.

D. Quality and Dispute Resolution:

While Leads Genie Consultants are carefully vetted and trained, we cannot guarantee the specific results of their work. It’s your responsibility to clearly communicate your needs and expectations to the consultant before starting the engagement.
If you are unsatisfied with a consultant’s work, please contact us at hello@xuniversepro.com within 10 days of project completion. We will work with you and the consultant to find a resolution.

E. Non-Solicitation:

By using the Leads Genie platform, you agree not to solicit or engage a Leads Genie Consultant directly outside of the platform without our prior written consent. Consultants are similarly prohibited from soliciting or accepting direct engagements from users outside of the platform.
To request permission for an ongoing professional relationship outside the platform, both you and the consultant must contact us at hello@xuniversepro.com. We will review the request and make a decision based on our policies and the specific situation.

32. MISCELLANEOUS

These Terms constitute the entire agreement between you and Leads Genie with respect to the subject matter hereof and supersede all prior or contemporaneous communications and proposals, whether oral or written. If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.
